Fundraiser terms & conditions
Running a fundraiser with us should be simple, so these terms are written to be read rather than skimmed past. If anything here is unclear or does not work for your organization, tell us before you sign — most of it we can talk about.

1Who this agreement is between
This agreement is between McCay Enterprises LLC, trading as Best Darn Kettlecorn, 6401 Radcliffe Street, Bristol, PA 19007 (“we”, “us”), and the organization named on the sign-up form (“you”, “your group”).
The person signing confirms they are authorized to enter into this agreement on behalf of the organization.
2What your group earns
Your group keeps 50% of product sales, calculated on the price of the popcorn before any shipping charges and before sales tax.
There is no deposit, no set-up fee and no minimum order. It costs your group nothing to run a fundraiser with us.
If a fundraiser finishes very small we will still deliver it — we will just talk to you about whether the timing or the promotion could have gone better, so the next one does more.
3How long your fundraiser runs
Your selling window — the first and last day supporters can order — is agreed in writing before you launch and is set out on your sign-up form. Most groups run two weeks.
Orders close at 11:59pm on the last day. We cannot accept orders after that, because the delivery date depends on it.
If you want to extend, ask us before the closing date. An extension changes the delivery date and both have to be agreed again.
4Delivery — one drop-off, one address, one agreed day
We deliver once. Everything your group sold arrives together, in a single delivery, to a single address that you give us on the sign-up form.
The delivery date is agreed before we accept your fundraiser. We will not confirm a date we cannot make. If you are working to a hard deadline — a game, a concert, a holiday — tell us at the enquiry stage.
Somebody from your group must be present to receive the delivery, check it against the packing sheets, and sign for it. Please tell us who and give us a mobile number for the day.
If the agreed date has to move, either of us can ask, but both have to agree the new date in writing. We are not able to hold finished product indefinitely.
We do not deliver to individual homes, and we do not split a delivery across multiple locations.
5Shipped orders
Supporters who cannot collect from your group may choose to have their order shipped to their own address. Shipping is charged at the carrier's rate, quoted at checkout, and paid by the supporter.
Our usual store shipping offers — flat-rate and free shipping over a threshold — do not apply to fundraiser orders.
Shipped orders count toward your group's total and your group's 50% share, calculated on the product price only, not on shipping.
6Flavors and product
Every fundraiser includes our core six flavors. Your group chooses three more from the current fundraiser list, agreed before launch.
Seasonal flavors are made to order for fundraisers and can usually be offered outside their normal season — ask us.
We may substitute a flavor if an ingredient becomes unavailable. If that happens we will tell you before we make the substitution and agree a replacement with you.
All popcorn is popped fresh for your fundraiser. It is not held stock.
7Allergens and ingredients
All fundraiser flavors are nut-free. Our kitchen handles wheat. Our kitchen does not handle peanuts.
Because wheat is handled on site, nothing we make is suitable for someone with coeliac disease or a wheat allergy.
A full ingredient and allergen sheet for every flavor on your line-up is provided with this agreement and must be made available to your supporters before they order. If your school or district requires its own approval process, tell us and we will provide whatever documentation they need.
It is your group's responsibility to pass the allergen information on to the families taking part.
8Payment
Supporters pay us directly by card at the time they order. Your group never handles money and never has to collect cash.
We pay your group's share within 14 days of delivery, by check or bank transfer, to the organization named on the sign-up form. We do not pay individuals. 🟡
If a supporter's payment fails or is charged back after delivery, that order is removed from your group's total and the share is adjusted on the next payment or invoiced back. 🟡
9Refunds and cancellations
Either of us may cancel before your selling window opens, at no cost to anyone. There is nothing to refund because there is nothing to pay.
Once selling has opened, orders belong to the supporters who placed them and the fundraiser runs to its end date.
A supporter may cancel their own order any time before the selling window closes and will be refunded in full. After that the popcorn is being made to order and cannot be cancelled.
If product arrives damaged or wrong, tell us within 48 hours of delivery and we will replace it or refund it.
10Your sellers and their information
You provide a roster of seller names. We show you exactly how each name will appear before anything goes live, and nothing is published until you approve it.
Sellers appear publicly by first name only. A last initial is added only where two sellers share a first name within the same class or group. You may instead choose first-name-only, first name and last initial, or seller numbers.
We do not create accounts for children. No child gives us an email address, a password or any other personal information.
Seller pages showing an individual's own sales are given to you, the organizer. It is entirely your decision whether to pass them on to families.
We use seller names only to run your fundraiser. We delete them within 90 days of delivery unless you ask us to keep them for a repeat fundraiser. 🟡
11Your supporters' information
We never sell, rent or share your supporters' details with anyone. We never pass your list to another organization.
Supporters buy from Best Darn Kettlecorn and become our customers. Those who opt in to marketing may hear from us directly, and can unsubscribe at any time.
We do not provide your group with your supporters' contact details, other than the name and order shown to the seller they supported.
12Kettlecorn Cash
Sellers earn Kettlecorn Cash based on the number of items they sell, on the published ladder.
Kettlecorn Cash is issued as a printed gift card, handed to your group with the delivery. It is redeemable in person at our Bristol Amish Market store for twelve months from the delivery date.
It spends like cash on anything we sell, is not redeemable for cash, and is not valid on fundraiser orders.
Lost or destroyed cards cannot be replaced. 🟡
13Prizes
Prizes and their budget are agreed with you before launch and are awarded by your group according to your own policy. We supply the budget; we do not decide who wins.
Where a prize is a popcorn party or product, we agree the date and quantity with you separately.
14Marketing and your logo
You give us permission to use your organization's name and logo on your fundraiser pages, your QR code, your launch materials and your sellers' pages, for the duration of your fundraiser.
We would like to mention your fundraiser and its result in our own marketing. We will ask you first, every time, and you can say no without it affecting anything.
You may use our name and logo to promote your own fundraiser.
15If something goes wrong
We will make good any product that is damaged, incorrect or short on delivery.
We are not able to accept responsibility for losses beyond the value of the product itself — for example a cancelled event, or a fundraising target not being met. 🟡
Neither of us is responsible for delays caused by events outside our reasonable control, including severe weather, supply failures or public emergencies. If that happens we will agree a new delivery date with you as quickly as we can.
16The small print
This agreement, together with your completed sign-up form, is the whole agreement between us. Changes have to be agreed in writing by both of us.
This agreement is governed by the laws of the Commonwealth of Pennsylvania. 🟡
If any part of this agreement turns out to be unenforceable, the rest still stands.
